These Terms govern your use of trypath.io, app.trypath.io, partners.trypath.io, and the property tours and services provided by Path Intelligence Corp ("Path," "we," "us"). By creating an account, taking a tour, or texting or emailing with us, you agree to these Terms.
Path provides AI-guided immersive property tours that open in a browser on a phone, tablet, or computer, with no app and no headset required. Customers upload property media, publish tours, share them with prospective buyers and renters, and receive engagement and lead information from those tours.
You must be at least 18 and able to enter a contract. You are responsible for your account credentials and for activity under your account. Tell us promptly at support@trypath.io if you suspect unauthorized access. Keep your account information accurate.
Paid plans are billed in advance on the interval shown at checkout. Payments are processed by Stripe. Unless stated otherwise in writing:
You keep ownership of the property media, listings, and other content you upload. You grant Path a worldwide, non-exclusive license to host, process, reproduce, adapt, and display that content solely to operate and support the service, including generating tours and powering the AI guide.
You represent that you have the rights to everything you upload, including photography, floor plans, and branding, and that your content and its use through Path do not infringe anyone's rights or violate any law, MLS rule, or IDX agreement.

Tours may include an AI guide that answers visitor questions. AI output can be incomplete or wrong. It is not professional, legal, financial, or real estate advice, and it is not a substitute for the listing agent, an inspection, or the official listing documents. Always confirm property details with the responsible agent or broker. Path is not liable for reliance on AI-generated answers.
These terms apply to text messages sent by or on behalf of Path Intelligence Corp.
Path sends text messages to people who have given their express consent, for these purposes:
You opt in by providing your mobile number and agreeing to be contacted by text at the point of collection, on a web form, in a tour, or by texting us first. Consent to receive marketing text messages is not a condition of purchasing anything from Path.
Message frequency varies and depends on your activity. In most cases you will receive a small number of messages related to an inquiry you started. Account notifications are sent as events occur.
Message and data rates may apply. Path does not charge for the messages, but your mobile carrier may. Contact your carrier for details on your plan.
Reply STOP to any message to opt out at any time. You will receive one confirmation that you have been unsubscribed, and we will send no further messages unless you opt in again. You may also email support@trypath.io to be removed.

Carriers are not liable for delayed or undelivered messages. Delivery is not guaranteed and may be affected by your carrier, device, or coverage.
Path does not sell your personal information. We do not share mobile opt-in information or SMS consent with third parties or affiliates for their marketing purposes. Mobile numbers collected for messaging are used only for the purposes described above and shared only with the messaging providers who deliver messages on our behalf. See our Privacy Policy.
Tours and pages may link to third-party sites and services, including MLS and IDX sources. We do not control them and are not responsible for their content or practices.
We aim for high availability but do not guarantee uninterrupted service. We may modify, suspend, or discontinue features. We will give reasonable notice of material changes that reduce functionality on a paid plan.
The service is provided "as is" and "as available." To the fullest extent permitted by law, Path disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Path does not warrant that property information displayed in a tour is accurate, complete, or current. That information comes from our customers and their data sources.
To the fullest extent permitted by law, Path is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Path's total liability for any claim relating to the service is limited to the amounts you paid Path in the twelve months before the event giving rise to the claim.
You will defend and indemnify Path against claims arising from your content, your use of the service, or your violation of these Terms or of any law.
You may stop using the service at any time. We may suspend or terminate access for breach of these Terms, non-payment, or legal risk. On termination, your right to use the service ends. We will make your content available for a reasonable period for export unless prohibited by law.
These Terms are governed by the laws of the State of Delaware, without regard to conflict of laws rules. [TODO: confirm with counsel whether you want Delaware or Florida, and whether to add an arbitration clause and class action waiver.] The state and federal courts located in Delaware will have exclusive jurisdiction, and both parties consent to venue there.
We may update these Terms. We will revise the "Last updated" date and, for material changes, notify account holders by email or in-product. Continued use after changes take effect means you accept them.
